This website is operated by Paul Wylde Art. Throughout these Terms, “we”, “us” and “our” refer to Paul Wylde Art.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.

THESE TERMS
These Terms apply when you visit our website or purchase a product from us. They should be read together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
Nothing in these Terms limits or removes any rights you have under applicable consumer law.

USING OUR WEBSITE
You may use this website only for lawful purposes. You must not:
• interfere with the security or operation of the website;
• introduce viruses, malicious code or harmful technology;
• attempt to gain unauthorised access to any part of the website;
• collect information about other users without permission;
• use our artwork, images or content without authorisation; or
• use the website in a way that infringes another person’s rights or violates applicable law.
We may restrict access to the website where reasonably necessary to protect our business, customers or systems.

PRODUCTS AND ARTWORK
We make reasonable efforts to describe and display our artwork and products accurately. However, colours and appearance may vary depending on screen settings, lighting and the device used.
Fine-art prints may display minor natural variations resulting from the printing process and the texture of the paper. Such characteristics are not necessarily defects.
Product dimensions refer to the paper or artwork size stated on the relevant product page. Prints are supplied unframed unless expressly stated otherwise.

ORDERS
Placing an order constitutes an offer to purchase the selected product. A binding contract is formed when we accept your order and send an order confirmation.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
• payment has not been authorised;
• product or pricing information contains a clear error;
• a product cannot be fulfilled;
• we suspect fraud or unlawful activity; or
• delivery is unavailable to the supplied address.
If we cannot accept an order after payment has been taken, we will refund the amount paid.
Please review your product selection, size and delivery details carefully before placing an order. Our prints can enter production shortly after acceptance, so requested changes may not always be possible.

PRICES AND PAYMENT
The product price, applicable taxes and delivery charge will be displayed before you submit payment.
Prices and availability may change, but changes will not affect an order that we have already accepted.
Payment is processed through the methods offered at checkout. You confirm that you are authorised to use the selected payment method and that the payment information supplied is accurate.

PRODUCTION AND DELIVERY
Fine-art prints are produced individually to order through a specialist print fulfilment network. Production may take place at different facilities depending on the product, destination and availability.
Delivery areas, charges and estimated delivery times are explained in our Shipping Policy and displayed at checkout.
Delivery dates are estimates and are not guaranteed. We remain responsible for the goods until they are delivered to you or to a person identified by you to receive them.
You are responsible for supplying a complete and accurate delivery address. Contact us immediately if you discover an error. We cannot guarantee that an address can be changed after production begins.

CANCELLATIONS, RETURNS AND REFUNDS
Your cancellation and return rights are described in our Return and Refund Policy.
For eligible online purchases, you normally have 14 days after receiving the goods to tell us that you wish to cancel, followed by a further 14 days to return them.
Please contact us before returning anything so that we can provide the appropriate instructions. Products must not be returned directly to our print manufacturer or to an address shown on the packaging unless we specifically instruct you to do so.
This section does not affect your rights where goods are faulty, damaged, incorrect or not as described.

DAMAGED, FAULTY OR INCORRECT PRODUCTS
If an item arrives damaged, faulty or incorrect, contact paul.wylde.art@gmail.com as soon as reasonably possible. Include your order number and photographs of the artwork, packaging and shipping label where available.
We will provide an appropriate remedy in accordance with your statutory rights. This may include a replacement, repair, price reduction or refund, depending on the circumstances.

INTELLECTUAL PROPERTY
All original artwork, reproductions, photographs, product images, written content, logos, branding and website materials belonging to Paul Wylde Art are protected by copyright and other intellectual property rights.
Purchasing an original artwork or print gives you ownership of the physical item only. It does not transfer copyright or grant permission to reproduce, distribute, publish, alter, commercially exploit or create derivative products from the artwork.
You may not download, reproduce or use our content commercially without prior written permission.

THIRD-PARTY SERVICES
Our website uses services supplied by Shopify and may use other providers for payments, fulfilment, analytics, communications and delivery.
Those providers may process information or provide functionality necessary to complete your order. Their use of personal information is addressed in our Privacy Policy.
Links to third-party websites are provided for convenience. We are not responsible for third-party content or services outside our reasonable control.

OUR RESPONSIBILITY
We do not exclude or limit liability where doing so would be unlawful. This includes liability for:
• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• breach of your statutory consumer rights; or
• any other liability that cannot legally be excluded.
We are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable, losses caused by information or instructions supplied incorrectly by you, or business losses arising from a purchase made primarily for commercial purposes.

EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, carrier disruption, industrial action, governmental action, conflict, natural disaster or widespread network failure.
Where such an event materially affects an order, we will take reasonable steps to contact you and minimise the impact. Your statutory rights remain unaffected.

PERSONAL INFORMATION
Our collection and use of personal information is explained in our Privacy Policy. Shopify and other necessary service providers may process information to operate the store, take payment, fulfil orders and provide customer support.

GOVERNING LAW
These Terms are governed by the laws of Northern Ireland.
If you are a consumer living elsewhere in the United Kingdom or European Union, you also retain any mandatory protections provided by the law of the country in which you live.
Nothing in these Terms prevents a consumer from bringing a claim in any court available to them under applicable consumer law.

CHANGES TO THESE TERMS
We may update these Terms when our services, business practices or legal obligations change. The version applying to your purchase will be the version in force when your order is accepted.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
